Guidelines and Requirements for Registration of Aviation Fuel Suppliers
GUIDELINES AND REQUIREMENTS FOR REGISTRATION OF AVIATION FUEL SUPPLIERS
PROCEDURE
- Application for Registration as an aviation fuel supplier shall be made in writing and addressed to the Director General, Nigerian Civil Aviation Authority (NCAA).
- The application shall be signed by the lead promoter of the proposed business or Chief Operating/Executive Officer of the applicant company.
- The application shall be submitted to the office of the Director General, Nigerian Civil Aviation Authority (NCAA) on or before a date not less than six (6) months to the intended date of commencement of operation.
REQUIREMENTS
A. The application for Registration must contain the following initial particulars:
i. Name and official company address(es) of applicant, as well as:
- Applicant’s CAC Registration Number (RC)
- Contact telephone numbers
- Valid e-mail address(es)
- Names and nationalities of Directors of the company at the bottom of the page
ii. Airports/terminals where the applicant operates and airports for intended operation, if any.
iii. Name(s) and full address(es) of the technical partner(s), with copy/copies of the relevant agreement(s);
B. The applicant is expected to submit the following documents:
i. Evidence of Payment of Five Hundred Thousand Naira (N500,000.00) non-refundable processing fee, as well as Two Hundred Thousand Naira (N200,000.00) Depot/Facility Approval Fee per Depot to NCAA (Bank draft made payable to the Authority).
ii. Completed processing form (NCAA/AFS/Form.01) with the evidence of payment of the above N500,000.00 non-refundable processing fee and all the depot approval fees.
iii. Certified true copy of the company’s Certificate of Incorporation;
iv. A certified true copy of the company’s Memorandum and Articles of Association;
v. Statement of share capital/return of allotment of shares (Form CAC 2) indicating Minimum Authorized Share Capital of One Hundred Million Naira (N100,000,000.00); and ownership structure of the company reflecting Majority Shareholding and control vested in Nigerian nationals;
vi. Company Profile, including ownership structure and list of Directors of the company;
vii. Copy of a valid Petroleum Products Import Licence/Permit issued by the Department of Petroleum Resources (DPR) or evidence of through-put arrangement with a shore/coastal depot or evidence of ownership of coastal depots;
viii. Evidence of Depot Agreement (Lease etc) or Space Allocation for storage depot in each airport of operation, issued by the Federal Airports Authority of Nigeria (FAAN);
ix. Evidence of tax payment issued by Inland Revenue Service and copies of tax clearance certificates of the company and each of the directors, for the last three (3) years;
x. Evidence/details of insurance policy to cover the business indicating One Billion US Dollars (USD 1 Billion) cover for each airport;
xi. Feasibility study report detailing the proposed operations plans for each of the intended airports;
xii. List of key personnel responsible for the Aviation Fuel Supply services of the company; and in respect of each of the airports served by the company, with evidence of their relevant background(s), e.g training certificates, licences, curricula vitae etc;
xiii. Curriculum vitae as well as evidence of relevant training of each Director (e.g certificates, licences);
xiv. Minimum of three (3) serviceable browzers and accessories.
C. ADDITIONAL REQUIREMENTS
An applicant, having fulfilled other requirements, shall be required to:
i. Obtain the following technical/quality acceptance from the Directorate of Airworthiness Standards (DAWS);
ii. height clearance (for depots/structures) and attestation of adequate fire cover/protection from the Directorate of Airspace & Aerodrome Standards (DAAS); and
iii acceptance of security programme from AVSEC department of NCAA;
iv. Comply with the conditionality for facilities to design, in line with JIG recommendations for Filtration,
Test Rig, spill containment, Fire fighting and oil-water separation;
v. Comply with Procedure Guide for the Construction and Operation of Petroleum Products Depots and Facilities, issued by DPR;
vi. Submit the following Manuals (which must meet the requirements of ICAO Document 9977):
a. Company Operations Manual
b. Quality Control Manual
c. Health, Safety and Environment Manual; and
d. Emergency Response Manual
The Manuals may be combined. All required Manuals must be current to the Petroleum and Aviation Industry fuel practices (Like ICAO Document 9977, JIG Publications, ISO Publications, IATA Publications, DPR Publications, SON, NIS).
vii. Comply with NCAA Advisory Circular NCAA-AC-AWS 023 (as amended) on Storage, Handling and Quality Control of Aviation Fuel at Aerodromes;
viii. Submit a copy of the Engineering Drawing;
xi. Provide proof of site-Emergency Response;
x. Have a pool of technically competent workforce (professional competence and training records);
xi. In line with the Nigeria Civil Aviation Regulations (Nig. CARs) 2015 and prior to issuance of the Licence,a combined team from DATR, DAWS, DAAS and AVSEC Department of NCAA shall inspect the applicant’s fuel facility/installations, the cost of which will be borne by the applicant. Subsequently, regular monitoring and inspections shall be carried out on the company’s facilities;
xii. The applicant must at all times comply with the provisions of the Nigeria Civil Aviation Regulations (Nig.CARs 2015) Part 18.9.1 (vi), by maintaining the authorized standards in terms of the facilities, procedures and personnel training to ensure adequate protection against fire and explosion; handling, storage and dispensing of fuel in the airport environment; and
xiii. The applicant must at all times comply with the fire code and any other relevant safety and/or security standards of the airport operator.
D. ISSUANCE OF LICENCE
Upon satisfaction that the applicant has demonstrated the ability to render safe and efficient service, the Authority will issue to the applicant an authorization Licence.
E. VALIDITY OF LICENCE
- The validity of the Licence shall be for Five (5) years;
- Upon receipt of the Licence, utilization fee of Two Hundred and Fifty Thousand Naira (N250,000.00) only shall be paid to the Authority annually.

You may wish to recall that the DG had earlier approved in principle, the draft Guidelines and Requirements for the Registration of Aviation Fuel Suppliers, as well as a sample of the proposed Certificate (ref. pages 1-7).
- You may further wish to observe that DG, in the tentative approval, directed that DATR should “coordinate with the other relevant directorates” on the issue.
- In view of the directive, DATR has met with and received the inputs of DAWS and DAAS, which have also been incorporated in the new drafts of the Guidelines & Requirements and the sample Certificate.
- The new draft documents, including the Registration Form and the letter of notification to Aviation Fuel suppliers, are at back cover of file for your consideration and further necessary action, please.
